Competition Law

A competition lawyer must always improve knowledge of the legal framework and case law and be updated with all the legal and case law developments at the national level, but also at the EU level and at the level of countries in Europe and oversees. Having this in mind, I have decided to continue my studies and I applied for a Post Graduate EU Competition compliance program organized by King’s College London and thereafter I completed a Master of Arts in EU competition law, also with King’s College, London.

The knowledge I got from the studies I followed and the practical cases I handled, enabled me to draft and implement a Competition Law Compliance manual in Telekom and perform training to executive management in order to make them aware about the implications of the breaches of the competition regulations. I have also been actively involved in the process of amending the competition legislation in Romania (2010), a process needed for the alignment of Romanian legislation to the latest European developments. In terms of experience, I managed:

  • Vertical agreements (notifying the Romanian Competition Council with respect to several distribution and agency agreements and obtaining individual exemption in respect hereof according to the old legislation)
  • Horizontal cooperation agreements
  • Notifying mergers and obtaining clearance in respect hereof
  • Assisting clients during investigations launched by the Romanian Competition Council including assistance during dawn raids
  • Providing continuous advice with respect to dominance whenever the pricing strategy or other strategic business decisions are to be taken by the clients

Key competition law projects:

  • Competition law analysis of a big DTH project (Dolce TV retransmission business)
  • Implementation of the entire distribution and agency agreements system in Telekomy
  • Legal assistance and support in respect of all mergers implemented by Telekom
  • Legal analysis of the implications arising out of the joint venture procurement tool created between two big telecom companies
  • Legal support for the joint procurement agreement signed between two major TV companies for the purchase of the UEFA TV rights for Champions League and Europa League competitions
  • An investigation launched by the Competition Council finalized with no sanction
